Good Morning,
I read a terrible story out of Ohio last week. A woman who had a high-risk pregnancy in 2021 was ordered to be on bed rest by her doctor, but her employer, Total Quality Logistics, insisted she continue to work from the office — even though her job could be done remotely.
She was in a tough situation, as her health insurance was tied to her employment and she didn’t want to lose her job while pregnant. She continued to go into the office against her doctor’s orders under threat of unpaid leave, and ultimately went into labor at 21 weeks pregnant; her daughter died 90 minutes after she was born.
Their counsel shared the following:
“The evidence showed that Chelsea Walsh was following her doctors’ instructions for a high-risk pregnancy and simply asked to work from home. The jury found that TQL’s denial of that reasonable request led to the death of her daughter.”
The woman was awarded $22.5M. If companies in the future consider similar treatment again (as appalling as that may be), hopefully the financial threat will force them to reconsider.
